Yesterday Fathers and Families Ohio Director was featured in their latest newsletter. Don Hubin and I have an extensive history that goes back to when he brought me into the Father’s Rights movement with an organization called Parents And Children for Equality (PACE). As a Chapter Director, one of the first assignment that I had was working on the writing of what was the very first equal custody bill ever introduced in any state legislature (HB232).

I will not go into a lot of detail but that became a real eye opener on the workings of State Government and what it takes to create a law and what is need in preparation to trying to get that law passed. I can go into the many failings of Don during that process of that bill but that experience set my resolve to get this job done for every parent across the country.

He his latest rambling for F&F he attempts to fall back on the old Constitutional Rights argument that has failed in every level of the courts and is one that I broke away from using long ago. As Senator Skindell told me when I was able to completely explain the argument, “It is too complicated and will go over a legislator’s head”.

The question that needs to be posed to Don Hubin is why when there was a bill introduced that met all these requirements that you are now calling for, why did you choose to block that legislation? Is it because you didn’t do it Don and Fathers and Families could not profit from a successful bill passing? Hate to tell you Don, that mythical pot of gold does not exist.

The best thing that we can all do is tell them to stay away. Take your fund raising efforts to the suckers that you continue to hornswoggle with your words that you fail to back up with action and go away for the betterment of every parent in the nation.

That is why I continue to press the single question of “Why do we remove fit parents from the lives of our children?” Like the asking for a legal definition of “Best Interest of the Child” it is the loaded question that can be explained by anyone.  ~~

• Maintain regular contact with both parents and a clear explanation for any change in plans and/or cancellations.

• Enjoy a pleasurable relationship with both parents, never to be employed as a manipulative bargaining tool.

• The obligation of being a parent does not end after a divorce.

It is extremely important to understand that the bond of marriage is completely different from that of parents. This is the most common downfall in today’s society, as a dissolution of marriage takes place so does that of parenting.

 

A WORD ABOUT SELF REPRESENTATION ~ The Sixth Amendment to the U.S. Constitution has been interpreted to provide EVERY AMERICAN with the CONSTITUTIONAL right to self-representation, if they so choose. That privilege, like all other constitutional rights, should be enjoyed without fear of harassment, prejudice, or abuse.

Furthermore, no law, regulation, or policy should exist to abridge or surreptitiously extinguish that right. Self-Represented Litigants have no less of a right to FAIR and MEANINGFUL due process under the federal and state constitutions as those individuals who choose to utilize an attorney for their legal affairs and issues. In fact, NOWHERE in any state or federal constitution does it specify that the hiring of a lawyer is a prerequisite to exercising one’s due process rights.

Democratic principles dictate that we have the right to freely choose between self-representation and hiring a lawyer to handle our legal matters without suffering humiliation, prejudice, or penalization. After all, it is the parties to the litigation that ultimately have to deal with the consequences of the case’s outcome, and not the judge or the lawyers involved in the matter.

Contrary to the view of certain judges and lawyers, those who opt to litigate their own legal matters without an attorney are NOT second-class citizens deserving of contempt and injustice. Instead, they are BRAVE CITIZENS with an inalienable right to have their legal causes adjudicated objectively and justly — with or without a lawyer.

Self-representation can be a difficult, time-consuming, and often frightening experience, especially for those burdened by demanding work schedules, family responsibilities, and other obligations of day-to-day living.

Accordingly, those who engage in the difficult task of self-litigation should be REVERED for their COURAGE and DEDICATION, not scorned or abused.

We also need to amass momentous opposition against those persons, agencies, and institutions who, in the interest of protecting huge profits, careers, and prestige, subject self-litigants to a hostile and often abusive litigation atmosphere calculated to suppress self-representation and force people to become completely and financially dependent on lawyers to gain “paid” access to a taxpayer-funded legal system.

Fighting war against terrorists in Iraq, Iran, and Afghanistan is a diversion to keep the citizens of the United States distracted about the terrorist psychopaths in the American Legal System. I have discovered that there is no access to the United States legal system for the middle class and poor of the United States. I came to these courts asking for justice and I left further …injured. When I asked the legislature and the administrative system that is set up to oversee the legal system, I was sent a curt response that no laws or ethics had been violated. These administrative personnel have condoned the use of terror in our court system. The administrative personnel and/ or pathology personalities have colluded with the crooks of the system and have become supporters of terror (tools of the psychopath).

Our courts have become tools for the wealthy to oppress the poor. I have recently discovered that there are administrative laws on the books of each state. Although these laws are not available to the public, you must have access to the legal search engines to find these laws. You will need to go to a law library and use the legal search engines to find the laws of your state. This is another aspect of terrorism, keep the rules secret, and run by a secret organization that is not monitored by public citizens.

I am not an attorney and after I have seen what attorneys do, I would never become a part of this terrorist organization which support techniques of abuse used by pathological personalities. You must adhere to the rules of the crime boss to continue to practice law and if you decide to “spill the beans to the public”, you will fear physical and financial death. The terror system that I faced was family court.

This court claims to assist families in the state break the state contract of marriage. They actually post the motto: “Helping the families of Florida”. While in reality, they are torturing and committing Florida families to a life of torture and grave danger; financially, physically and emotionally. I am unable to afford an attorney and the system wants me to go away and accept the crimes they have committed.Worst place is the family courts - 2015

This court system has caused complex Post Traumatic Stress Disorder, an injury that many terrorist organizations skillfully employ to damage and keep the victim lifeless and quiet. The same occurs all over the nation. Our system of justice plays favorites; you are a favorite until the money runs out or if you have more money than the other spouse. Divorce to a personality disorder is war and there are disordered attorneys who also have no conscience. I hope that one day we will all be able to heal and join together to stop the legal torture of vulnerable citizens.

Without a dispassionate and objective justice system based directly on the Constitution there can be no justice. Individuals must know they can have justice despite income or condition. Basically, if you are a parent of one or more natural/biological children, you also were unlawfully victimized by either above-described American “family court” system within the past four years (whether still currently or not), and you currently live in one of the 50 States/Commonwealths, you qualify to be a Member of CAPRA and fully participate in everything described upon this website. However, there are per-geography limits.
For various reasons, the total membership of CAPRA will be limited to a maximum of the first 51,764 qualified registrants, which is population-density based, including up to twelve (12) Members allowed to join and participate from the very least populated, most rural Localities, and likewise by different population-density thresholds, up to a max of twenty-eight (28) Members from each of the many most populated Localities.
About 95% of all such 3142 U.S. Census “Localities” are called “[something] County” while the rest are county-equivalents, like “boroughs” and “census areas” in Alaska, “parishes” in Louisiana, and even “independent cities” like St. Louis, Baltimore, and others, which are cities not part of any counties, with their own borders, etc. Using different population thresholds, each different Locality is shown with either three (3), five (5) or seven (7) CAPRA membership slots on this example spreadsheet. Judge Manno-Schurr continues to look the other way and allow it to continue.  The judge has not followed Florida law or Florida case law in making her decisions. She is blatantly biased towards dads. She has allowed severe parental alienation and assisted my ex-fiance to permanently damage my once close and loving relationship with my daughter by enabling her to alienate me for an extended period of time.

Who polices the police? Who judges the judges? Where is the ACCOUNTABILITY?!?!

It is SHAMEFUL what is allowed to go on in family courts ALL OVER THE WORLD. Abuse of power, Abuse of discretion, Connections, Control, Perjury, Parental Alienation (STOCKHOLM SYNDROME, TRAUMA BONDING, BRAINWASHING, EMOTIONAL CHILD ABUSE). As long as it continues to go on virtually UNCHECKED, it will only get worse. The abusers become emboldened when they continue to “get away” with it. This Father’s Day, and every day, all across America, there are children who are being denied access to their fathers, and most of these fathers were in their children’s lives prior.

People must awaken to the truth and the horrors of family law and see how it’s the other parent and the family courts that have bankrupted and broken them down.

Changes must be made to these systems so the court-induced parental alienation immediately ceases from them doing more harm to our children.

How is it in the best interests of our children that their fathers’ driver licenses are suspended, and they are eventually thrown in jail for inability to pay?

Here are fathers who are already broke, bankrupted, and brokenhearted and now without any ability to pay, they order him to pay or go to jail.

Where is someone supposed to come up with that kind of money when they’ve lost everything? Tell me, people. How is this in the best interests of our kids? (Yes, I am not disputing that there are some parents who don’t deserve to be parents — moms and dads.)What child support looks like - 2015

But most often, these are loving, “fit” fathers who have been engineered by a system designed to break them down in every way, until all they can do is run.

They are hopeless and the cycle then goes on! What happens to them when they run? They become despondent and commit suicide, like Chris Mackney, or get shot at, like Walter Scott!

Does it make sense to suspend a parent’s drivers license so now they can’t work, can’t get money to pay?

Does it make sense to throw a parent in jail because of an inability to pay, so that while he’s locked up his arrears get worse?

It’s up to us to break the cycle!

A denial of visitation rights by the custodial parent to a non-custodial parent, absent a change in an existing court order for visitation rights, is illegal. This is true both in situations in which the parents have agreed on a parenting plan outside of court, and in situations in which scheduled visitation has been ordered by the court. The legal phrase for this scenario is called frustration of child visitation rights, and in many states this can be cause to change the court-ordered child custody arrangement and hold the custodial parent in contempt of court.

In its 1979 parental rights decision Parham v. J.R., the United States Supreme Court declared,

“The law’s concept of the family rests on the presumption that parents possess what a child lacks in maturity, experience, and capacity for judgment required for making life’s difficult decisions.”Unfortunately, a bill recently passed by the New Jersey legislature completely throws out this presumption.

Assembly bill 3435 (A3435), “The Boys and Girls Clubs Keystone Law,” adds to New Jersey law that “when a minor believes that he or she is in need of behavioral health care services for the treatment of mental illness or emotional disorders, the minor’s consent to treatment…shall be valid and binding as if the minor had achieved the age of majority.”

This is scary enough if it puts a 16- or 17-year-old in the position to make such a serious and difficult health decision. But under this irresponsible bill, a child of any age could give legally binding consent for such treatments. There is no requirement for parental consent or even notification – for any child!

Of course, when we learned of A3435 we urged New Jersey supporters to call for its defeat and, more recently, for Governor Christie to veto it. So far, he has not done so.

Sadly, this bill reflects the growing dangerous trend of cutting parents out of the lives of their children. The new “wisdom” seems to hold that children are best left up to government experts or, barring that, their own devices.

It is the same argument used by the internationalists who push for the United Nations’ Convention on the Rights of the Child (CRC). They argue for children’s rights to make their own decisions and not be “burdened” by the superior wisdom and experience of their parents.

But that isn’t really the way life works. At some point, that decision is going to be made by an adult, whether it is the parent or an agent of the state.

The Parham Court recognized that dichotomy. “Simply because the decision of a parent is not agreeable to a child, or because it involves risks, does not automatically transfer the power to make that decision from parents to some agency or officer of the state,” Chief Justice Warren Burger wrote for the Court. “Most children, even in adolescence, simply are not able to make sound judgments concerning many decisions, including their need for medical care or treatment. Parents can and must make those judgments” (emphasis added).

The internationalists recognize the dichotomy, too – and simply hope the rest of us don’t notice. In speaking of the CRC’s “best interest of the child” provision, international legal scholar and CRC advocate Geraldine Van Bueren writes, Best interests provides decision and policy makers with the authority to substitute their own decisions for either the child’s or the parents’, providing it is based on considerations of the best interest of the child.”

So if the parents and the child disagree in court, the judge gets to make the final call – not the child. What’s more, under the “best interest” principle, the judge still gets to make the call even if the parent and child agree with each other, but happen to both disagree with the state.

In neither system, then, does the child get to make his own decisions. He lacks the mental and emotional capacity to do so. In the traditional American system, the parents are the safeguard to fill that lack and protect their child. In the new internationalist norm, the State is responsible to second-guess the child “for his own good.”

A3435 claims to let the child stand or fall completely on his own. But at some point, unless we protect the traditional role of parents, it will be an agent of the State who ultimately gets to decide. We agree with Chief Justice Burger: “Parents can and must make those judgments.”purple keyboard - A

However you choose to join in, know that standing together we can protect children – like those in New Jersey – by empowering parents to make those hard decisions with them and on their behalf. Parents, not bureaucrats, will best decide what is right for their child.

With out a father - 2015Most alienated parents are non-custodial fathers, and engaging these fathers is a significant challenge, as clinical and research literature has described the lack of “fit” between fathers and therapeutic agents as emanating from two sources: the characteristics of men and fathers themselves (their resistance to counseling and therapy), and aspects of the therapeutic process (which have failed to successfully engage fathers).

Patterns of traditional gender-role socialization directing men toward self-sufficiency and control, independent problem-solving and emotional restraint have largely worked against fathers being able to acknowledge personal difficulties and request help.

fear of self-disclosure and a feeling of disloyalty to one’s family in exposing family problems are not uncommon; a fear of losing control over one’s life and the need to present an image of control or a “facade of coping” in the form of exterior calm, strength, and rationality, despite considerable inner turmoil, characterize many fathers.

Professional service providers do not always consider such psychological obstacles to therapy and thus do not address fathers’ unique needs. The research on divorced fathers is clear about their most pressing need: their continued meaningful involvement with their children, as active parents. The lack of recognition of this primary need is the main reason for therapists’ lack of success in engaging alienated fathers.

Above all, the key to engaging alienated parents is to validate their parental identity, and combine advocacy efforts with counseling focused on enhancing their role as active and responsible parents. Human service professionals have been notably absent in the politics of reform with respect to the issue of legal child custody, yet they are desperately needed as allies in policy reform efforts.

An important role of human service professionals in supporting alienated parents is through such advocacy and activism, challenging the custodial/non-custodial and residential/non-residential parent dichotomy and advancing the cause of co-parenting.

Co-Parent - 2016

An active program of outreach is essential as alienated parents report a lack of effective support services, and they remain a highly vulnerable population. Service providers need to be persistent and proactive, as it takes time to build and sustain engagement in the context of these parents’ feelings of isolation, helplessness, and their tendency to wait until there is a crisis before accessing support. Parents who were highly involved with and attached to their children and suddenly find themselves forcefully removed from their children’s lives experience profound woundedness.

The experience of being removed as a loving parent from the life of one’s child via a sole custody order strikes at the heart of one’s being. Suicide rates are reported to be of epidemic proportions among parents, fathers in particular, who are struggling to maintain a parenting relationship with their children (Kposowa, 2000; Kposowa, 2003); and legal abuse has been noted as a key factor in these cases. Being vigilant regarding symptoms of post-traumatic stress and suicidal ideation among non-custodial and alienated fathers and mothers is an essential role for service providers.

A strengths-based approach, recognizing alienated parents’ aspirations to their children’s well being and the experience, knowledge and skills that they can contribute to this well being, while maintaining the high road in addressing the alienation, is vital.

And finally, what about the alienating parent, who uses a combination of fear, lies, flattery and gratification of material desires to win over their child, and whose sense of entitlement and desire to control the child is greater than the desire to nurture and care for the child?parental2balienation2b-2b2016

As Amy Baker writes, parents who try to alienate their child from the other parent subtlely or overtly convey a three-part message to the child: I am the only parent who loves you and you need me to feel good about yourself; the other parent is dangerous and unavailable; and pursuing a relationship with the other parent jeopardizes your relationship with me.

Alienating parents are themselves emotionally fragile, often enmeshed with the child, with a “sense of entitlement, needing control, knowing only how to take” (Richardson, 2006).

Yet although it is easy to pathologize and blame such parents, it must be remembered that alienating behavior is encouraged in the context of a legal adversarial forum where the goal is to “win” the custody or residence of one’s child. And although some would recommend a solution of removing child custody from alienating parents and placing children in the care of non-alienating parents, it is often very difficult to adjudicate who actually is the alienating and who is the targeted parent.

Family law judges are not trained in the finer points of child development and family dynamics, and can be easily swayed by legal arguments made on behalf of disputing parents, including alienating parents.

On the matter of parental alienation, I have come to see that the problem is systemic in nature; that is, the problem lies primarily in the adversarial nature of legal determination of parenting after divorce. Parents are set up to fight in an effort to win “primary residence” or “custody” of their children, and the system tends to reward those skilled in adversarial combat. Parents often win their case by disparaging the other parent as a parent, in effect engaging in alienating behaviors, and the system thereby encourages and produces alienating behavior.

A legal presumption of co-parenting, rebuttable in established cases of child abuse and family violence, may in fact be the most effective means of combating parental alienation and curtailing its damaging consequences, while at the same time protecting the safety and well-being of children at risk of abuse.

The final installment of our three-part series on parental alienation will examine programs, services and interventions that combat alienation, and seek to reunite estranged parents and their children while addressing the significant clinical challenges in working with alienating parents.

Parental Alienation

In this second installment of our three-part series on parental alienation, we turn our attention to alienated (targeted) and alienating parents. Parental alienation is the “programming” of a child by one parent to denigrate the other (targeted) parent, in an effort to undermine and interfere with the child’s relationship with that parent, and most often occurs within the context of a child custody conflict. This includes the “legal abuse” of parents who have been disenfranchised from their children’s lives subsequent to sole custody and primary residence judgments. Within an adversarial legal process, non-custodial parents are often subjected to shame and stigma, lack of access to their children, and devaluation of their role as parents. And those who speak about the pain and woundedness in their lives are subjected to a mean-spirited cultural response, where their talk of woundedness is mocked.
